Terms and Conditions

Welcome to SmoothApply! As used in these Terms and Conditions, "SmoothApply," "us," or "we" refers to SmoothApply and its affiliates.

PLEASE READ THE FOLLOWING CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. These Terms and Conditions ("Terms"), along with our Privacy Policy, govern your use of smoothapply.com and all related services. If you do not agree to these Terms, you must not access or use our platform.


1. ELIGIBILITY

By agreeing to these Terms, you represent and warrant to us: (i) that you are at least 18 years of age and have the legal capacity to enter into these Terms; (ii) that you have not previously been suspended or removed from our platform; and (iii) that your use of SmoothApply is in compliance with any and all applicable laws and regulations.

2. YOUR ACCOUNT

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. OUR SERVICES

SmoothApply provides the following services:

  • Resume builder: Tools to create, edit, customize, and export professional resumes.
  • Resume parser: Technology to extract structured data from uploaded resumes.
  • Job discovery: Aggregated job listings from public job board APIs to help you find relevant opportunities.
  • Application preparation: Tools to review job application questions and prepare your answers before applying.
  • Recruiter tools: Job posting and candidate discovery features for employers and recruiters.
  • Email and SMS outreach: Targeted communications connecting candidates with relevant opportunities.

4. RESUME BUILDER

The resume builder is provided for your personal, non-commercial use in creating resumes for job applications. You retain ownership of all content you create (text, data, uploaded photos).

Resume templates and designs are the intellectual property of SmoothApply. You may use them in your exported resumes but may not redistribute, sell, or reverse-engineer the templates themselves.

We are not responsible for the content of your resume. You are solely responsible for ensuring your resume is accurate and truthful. We do not guarantee that any resume created with our tools will result in a job offer or interview.

5. JOB DISCOVERY

Job listings displayed on SmoothApply are sourced from publicly available job board APIs (including Greenhouse, Lever, and similar platforms). We do not create, endorse, or verify job postings. All job listings are the responsibility of the posting employer.

Job availability, descriptions, and application requirements may change without notice. We make reasonable efforts to keep listings current but cannot guarantee accuracy.

When you apply to a job through an external link, you leave SmoothApply and are subject to the employer's or job board's terms and privacy policy. We are not a party to any employment relationship that may result from your use of our platform.

6. RECRUITER SERVICES

We provide a platform where recruiters and employers can post job listings and connect with candidates. Recruiters must register for an account and agree to these Terms.

All job postings must comply with applicable laws and must not contain discriminatory, misleading, or fraudulent content. Recruiters are solely responsible for the accuracy of their job postings and for their hiring practices.

We reserve the right to remove any job posting that violates these Terms or applicable law. Recruiters grant SmoothApply a non-exclusive, royalty-free license to display their job postings on our platform. Recruiter access to candidate data is limited to users who have opted in to share their profile.

7. EMAIL AND SMS PROGRAM

By opting in, you consent to receive email and SMS messages related to job opportunities, service updates, and promotional content. Messages may include sponsored content from recruitment partners targeting candidates who match specific criteria (job title, location, skills).

Message frequency varies. Message and data rates may apply for SMS. You can opt out at any time: reply STOP for SMS, or click unsubscribe in any email.

All communications comply with the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA). We do not sell your contact information to third parties.

8. ACCEPTABLE USE

You agree not to:

  • Use SmoothApply for any unlawful, fraudulent, or harmful purpose.
  • Submit false, misleading, or inaccurate information in your profile, resume, or job applications.
  • Impersonate another person or entity.
  • Scrape, data mine, or extract data from our platform without written consent.
  • Attempt to access other users' accounts or data.
  • Distribute malware, spam, or harmful content through our platform.
  • Interfere with or disrupt the operation of our services.
  • Use automated tools (bots, scrapers, crawlers) to access our platform without authorization.
  • Republish, redistribute, or commercially exploit our content, templates, or data.

9. INTELLECTUAL PROPERTY

SmoothApply, our logo, resume templates, website design, and proprietary technology are the intellectual property of SmoothApply and are protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our platform without our prior written consent. Recruiter branding, logos, and trademarks displayed on our platform remain the property of their respective owners.

10. USER CONTENT

You retain ownership of content you submit (resume text, uploaded files, application answers). By submitting content, you grant SmoothApply a non-exclusive, worldwide, royalty-free license to use, store, display, and process your content solely for the purpose of providing our services. This license terminates when you delete your content or close your account, except where retention is required by law.

Your content must not be illegal, infringe on third-party rights, or contain harmful material. We reserve the right to remove content that violates these Terms without notice.

11. PAYMENT AND FEES

SmoothApply offers both free and paid features. Free features (such as the basic resume builder) are available without payment. Premium features and recruiter services require a paid subscription or one-time purchase.

Applicable fees are clearly displayed before purchase. You will not be charged without your explicit authorization. We reserve the right to change our pricing at any time. Price changes will not affect active subscriptions until their next renewal date. We will notify you at least 30 days before any price increase takes effect.

Cancellation and refunds: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not provide prorated refunds for partial billing periods.

If you are charged due to a billing error, contact us within 30 days at [email protected] and we will issue a full refund for the erroneous charge. If we materially reduce the features included in your paid plan without offering an equivalent replacement, you may request a prorated refund for the remaining subscription period.

12. DISCLAIMERS

SMOOTHAPPLY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that our services will be uninterrupted, error-free, or secure.

We do not guarantee employment outcomes from using our resume builder or job discovery features. We do not verify the legitimacy of all job postings and are not responsible for fraudulent listings. Job listing data from third-party APIs may contain inaccuracies or become outdated. Nothing on this website constitutes professional career, legal, or financial advice.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMOOTHAPPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, EMPLOYMENT OPPORTUNITIES, OR GOODWILL.

Our total aggregate liability for all claims related to our services shall not exceed the amount you paid to SmoothApply in the 12 months preceding the claim, or $100, whichever is greater.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SmoothApply, its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

15. TERMINATION

You may close your account at any time through your account settings or by contacting us. We may suspend or terminate your account at any time if you violate these Terms, without prior notice. Upon termination, your right to use our services ceases immediately.

Account inactivity: If your account remains inactive (no login or usage) for 24 consecutive months, we may send you a notification email. If no action is taken within 30 days of the notification, we reserve the right to delete your account and associated data.

We may retain certain data after termination as required by law or for legitimate business purposes. Sections that by their nature should survive termination will remain in effect.

16. DISPUTE RESOLUTION

Informal resolution first: Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration: If a dispute cannot be resolved informally, you and SmoothApply agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in the State of California.

Class action waiver: YOU AND SMOOTHAPPLY AGREE THAT ANY DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. NEITHER PARTY MAY PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

Exceptions: Either party may bring claims in small claims court if they qualify. Either party may seek injunctive relief in any court of competent jurisdiction for matters related to intellectual property or unauthorized access.

17. GENERAL PROVISIONS

Governing law: These Terms are governed by and construed in accordance with the laws of the State of California, USA.

Changes to Terms: We may modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Your continued use of SmoothApply after changes are posted constitutes acceptance.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Assignment: We may transfer our rights and obligations under these Terms without notice. You may not transfer your rights without our written consent.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmoothApply.

18. FORCE MAJEURE

SmoothApply shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemics, internet or infrastructure outages, third-party service provider failures, cyberattacks, war, terrorism, labor disputes, or power failures.
